The Regional Trial Court (RTC) of Bohol, Branch 48 has dismissed the cases filed against a real estate developer and its officers following a compromise agreement between the parties involved.
The cases, numbered 27900, 27901, and 27902, were filed against former Provincial Administrator Alfonso “Ae” Damalerio II, Godfrey S. Digal, Alexander B. Zafra Jr., Neil Ryan T. Agan, and Liezel F. Retardo, all of Atharra Development Corporation (now Bohol Primeland Corporation).
The charges involved alleged violations of Sections 17 and 5 of P.D. 957, a law regulating the sale of subdivision lots and condominiums.
During a pre-trial conference on July 11, 2024, both the prosecution, represented by Atty. Ronald S. Baquiano, and the defense, represented by Atty. Ivaraxel Ericson, submitted a final compromise agreement to the court.
After review, Acting RTC Presiding Judge Rufo V. Naragas found the agreement not contrary to law, public policy, or morals, and subsequently granted it.
Based on this agreement, the court ordered a provisional dismissal of all cases.
All accused parties expressed their amenability to this decision when asked for comment.
The joint order also stipulates that the cash bond for each of the accused is to be released to their respective bondsmen.
RTC’s dismissal of the case marks a significant turn in these cases, potentially bringing closure to the legal proceedings.
